GPA holders in cooperative house building societies , Chandigarh
The problems being faced by holders of General Power Of Attorney in cooperative house building societies do not seem to be ending. When the transfer process of flat/share on the names of the GPA holders was in progress, one society approached Hon'ble High Court of Punjab and Haryana to seek redressal of their certin problems. The High Court in the matter of the CWP had passed an interim order which had stated that" The administrator will not take any policy decision which inter alia includes transfer of membership in favour of another person or to extend the area of operation of the society"
This order of the court was misinterpreted by the administration and the word ‘administrator' (an inspector level officer of the cooperative department) was deliberately interpreted to mean differently to what court ha in mind. In a bid to enforce the order of the court, JRCS, UT directed all democrtically elected managing committee to suspend the transfer of share /flat in the name of the persons holding the flat on GPA. It has acted as a bolt from the blue for all such who were intending to seek transfer on his name.
The anomaly was immedietely brought to the notice of the Administration and Shri Pawan Kumr Bansal, Union Minister of Parliamentary Affairs and wataer resources GOI, who wrote a letter to Advisor to the Administrator UT, to redress the grievances of the GPA holders after seeking legal opinion from the law department of UT. Mr. Bansal had contended that this order was in personal , applicable to the plaintiff society. Presmeably the word administrator has beeen mistaken as Chandigarh Administrator. Implementation, of an order relating to a specific society,in case of all the societies is not correct. Mr. Bansal endorsed our demand to get the matter examined by the law department t clarify the positio and the GPA holders may once again be allowed to tansfer their share/flat as per policy noified vide order 2nd March 2009.
I had hoped that this communication of the Union Minister would culminate into relief to the hapless GPA holders in Coopertive house Building societies, but Chandigar Aministration seems hellbent on prolonging the miseries of the aggrieved persons. Over two months after the Chandigarh Administration seeking legal opinion on the alleged faux pass, in interpreting the court orders, GPA holders cotinue to await Administration's decision.
Irony of the matter is that sources in the administration said it was a mistake and the bn shoulf have been lifted long ago. Worthy Sanjay Kumar, Secretary Finance too admitted " I know about the amter . The sty can not be imposed on the transfer of ownership ( in all oopertive societies)" This seemed to pave the way for the transfer of the flat in the names of the GPA holders. I have a question to ask : When will the flat owners can transfer the ownerwship in accordance with the policy notified vide order dated 2nd March, 2009.?
I have again submitted memorandum to the Advisor U.T. Chandigarh and the Union Minister Of Parliamentary Affairs, Shri Pawan Bansal drawing their attention to the matter with a request to intervene in the matter and restore rights bestowed in the policy enunciated by the Administration.
